Plaintiff v. Telepublishing

Plaintiff took a sales position with a weekly newspaper, which had pioneered voice person advertising in Boston. She was hired to sell the voice personal system nationally to other newspapers and magazines. She had been promised a fixed commission for each contract sold. She was projected to close 8-10 contracts in the first year. Instead, she sold over 20 contracts in the first six months, which resulted in a decision by the newspaper The to repeatedly reduce her commissions. She finally elected to leave the company. Keith L. Miller brought an action in Suffolk Superior Court seeking the full amount, which would have been payable under the original deal. The case was tried to a jury, resulting in a verdict for the Plaintiff for the full amount she was promised, a significant six figure sum.
