Plaintiff v. Toyota

The Plaintiff died from injuries while operating a Toyota 4Runner on I-95 in Northern Connecticut. The car swerved and rolled over, ejecting the operator from the vehicle, which landed on top of him. It appeared that he was not wearing a seatbelt at the time, although the family maintained that this reserve navy jet pilot always wore a seatbelt. Keith L. Miller hired an engineer, who investigated and concluded that the seatbelt mechanism was defective, causing it to stick in the retracted position and the reason it was not being used at the time of the accident. Mr. Miller brought a claim against Toyota, alleging the seatbelt was defective. The case settled prior to trial for just under one million dollars.
