The Plaintiff was operating a motor vehicle with the right of way entering an intersection. A Boston Police Cruiser entered the intersection from a side street with a stop sign, apparently responding to a shooting incident. The cruiser hit the Plaintiff's vehicle on the driver's side and drove it sideways almost forty feet. The cruiser was required by law to come to a complete stop before proceeding through the intersection. The officer claimed he had stopped, and cited the Plaintiff for failing to yield.  Keith L. Miller brought a cross-application for a complaint to issue against the police officer for failing to come to a stop and driving to endanger, which resulted in dismissal of both criminal applications. Mr. Miller then brought a negligence action in Suffolk Superior Court. The case was tried to a jury, with a verdict for the Plaintiff. The City of Boston paid a five figure judgment.
