Mark Equipment v. Owner
 

A demolition contractor entered into a contract to demolish buildings in Lowell, MA, receiving payment in the form of southern pine timbers salvaged from the project. When the job was partially complete, asbestos containing materials were discovered on the site, and the contractor stopped work. The owner instructed the contractor to resume work, but the contractor refused and was terminated. Keith L. Miller represented the contractor in a Middlesex Superior Court claim for losses incurred in performance of the contract. The case settled after mediation and a six figure payment to the contractor.
